Terms and Conditions

These Terms and Conditions of Sale apply to the sale of Goods and Services specifically for customers using Hertz Technologies Pty Ltd trading as Pacific Cliff products and services from September 2021. It constitutes the entire agreement between the parties and replaces all prior agreements, verbal or written. The Buyer agrees to purchase the Goods and Services subject to these Terms and Conditions. No variation to these Terms and Conditions is binding unless expressly agreed in writing between the Buyer and the Seller. The Quotation and these terms and conditions together form our contract with you, and are binding on you.

1. Definitions

“Company”, “our”, “we” or “us” means Hertz Technologies Pty Ltd trading as Pacific Cliff, ABN 11 636 195 787.
“Completion” means the completion of a delivery in accordance with the “Quotation”;
“Contract” the contract that is formed between you and us in relation to the delivery. This Contract incorporates the Terms and the Conditions and the Quotation;
“Force Majeure Event” means any event outside our reasonable control;
“Liability” means actions, awards, costs, claims, damages, losses (including without limitation any direct or indirect consequential losses), demands, expenses, loss of profits, loss of reputation, judgments, penalties and proceedings and any other losses and/or liabilities;
“Customer” either you or the Company;
“Quote” a web based quotation for the delivery through our website/app;
“Job description” the description of the delivery including pickup and delivery;
“You” means the person who contracts with us named in the Quotation;
“Job” means any services and/or work to be performed by us for you; and
“Writing” or “written” includes faxes and email.
Headings do not affect the interpretation of these terms and conditions.

2. Payment

Our delivery service is prepaid basis. Once a customer logs a job from our website by providing pickup and delivery addresses with detailed option including time frame. A quotation is generated. If the customer is happy with the quotation, then the job is provided to our delivery driver partners. After acceptance of the delivery, the customer is charged the quoted amount.

3. Refund Policy

Hertz Technologies Pty Ltd will provide the customer with a full refund upon request when:
(a) the delivery was not made, a full refund will be made;
(b) the delivery was not made within the time frame for premium delivery, in this case the customer will be charged as same day delivery (base rate) and the difference will be refunded;

4. Availability of service

Our service is an online based system. Availability of the service depends on traffic conditions in the road, demand of our service including public holidays. Surge charge may apply for high demand scenarios.

5. Calculation of delivery time

Delivery time is calculated from the time a driver partner accepts a job after a customer submits a delivery request. A job has not been accepted by a driver partner means no contract has been executed and no charge for customer would be initiated. Any exception must be documented in a separate written agreement.

6. Insurance and warranty

Any accidental damage to goods during delivery is covered by Hertz Technologies Pty Ltd of maximum value of $200. For higher cover separate insurance is required, this can be done through our partner insurer.

7. Authority to safe drop

Due to ongoing COVID-19, we want to make our process as contactless as possible. We encourage customers to select authority to safe drop. This will allow the driver partners to deliver the goods to the customer’s doorstep without signature /OTP (One Time Pin) authentication. If authority to safe drop is not allowed, the goods will only be delivered if signature/OTP is provided. If no signature/OTP is provided then the goods will be returned to the sender and the customer will be charged for the return delivery.

8. Tobacco and Alcohol

Tobacco and alcohol must be delivered to person (s) over 18 years of age as per the law. During the delivery time, if the driver thinks the recipient looks less than 25 years, he/she will be asked for ID. No delivery will be made if the recipient cannot provide proof of age if asked by the driver. Also, if no one is available to receive tobacco or alcohol over 18 years of age or the person receiving signs of intoxication, the delivery would be returned to the sender. Customers will be charged for the return delivery.

9. Complaints handling

At Hertz Technologies Pty Ltd we take our customers seriously. If you have any complaints, you can contact us through our website or call us at 02 9191 7416. We take measure to get back to you with an outcome within two weeks.
